1. Acceptance of Terms

Replace "DEXchange" with final product name and operating entity (e.g., "DEXchange, operated by [Company Name LLC]"). Decide if you need a registered business entity before launch.

By accessing or using DEXchange ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is a non-custodial cryptocurrency exchange interface that facilitates swaps between digital assets through third-party liquidity providers.

2. Description of Service

DEXchange provides a user interface for exchanging cryptocurrencies. The Service does not hold, store, or custody any user funds at any point during the exchange process. All transactions are executed through third-party exchange infrastructure. DEXchange acts solely as an interface layer and does not operate as a financial institution, money transmitter, or custodial exchange.

3. No Account Required

The Service does not require account creation, registration, or identity verification. No personal information is collected or stored as a condition of using the Service. Users interact with the Service by providing only a destination wallet address and initiating a transaction.

4. User Responsibilities

You are solely responsible for ensuring the accuracy of all transaction details, including destination wallet addresses, coin selections, and amounts. Transactions submitted to the blockchain are irreversible. DEXchange cannot recover funds sent to incorrect addresses or using incorrect network selections.

You are responsible for complying with all applicable laws and regulations in your jurisdiction regarding cryptocurrency transactions. You represent that your use of the Service does not violate any laws applicable to you.

5. Non-Custodial Nature

DEXchange never takes custody, possession, or control of your digital assets. Funds are transferred directly between your wallet and the exchange infrastructure. You maintain full ownership and control of your cryptocurrency at all times. DEXchange does not have access to your private keys, wallet credentials, or funds.

6. Third-Party Services

The exchange functionality is powered by third-party liquidity and exchange providers. DEXchange does not guarantee the availability, performance, or reliability of these third-party services. Exchange rates are determined by third-party providers and may fluctuate. DEXchange does not control or set exchange rates.

7. Risks

Cryptocurrency transactions involve inherent risks including but not limited to: price volatility, network congestion, transaction delays, smart contract risks, and potential loss of funds. You acknowledge and accept these risks by using the Service.

Exchange rates displayed are estimates and may change between the time a transaction is initiated and when it is executed. The final exchange rate is determined at the time of execution by the underlying exchange provider.

8. Prohibited Uses

Have a lawyer review this section. Depending on your jurisdiction and business structure, you may need to explicitly list restricted countries/regions (e.g., OFAC sanctioned nations) or add age restrictions.

You agree not to use the Service for any unlawful purpose, including but not limited to: money laundering, terrorist financing, fraud, or any activity that violates applicable laws or regulations. DEXchange reserves the right to restrict access to the Service at its discretion.

9. Limitation of Liability

Critical section — have a lawyer review. The liability cap and exclusions need to be appropriate for your jurisdiction. Some jurisdictions don't allow full exclusion of liability.

To the maximum extent permitted by applicable law, DEXchange and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising from your use of the Service.

DEXchange's total liability for any claim arising from or related to the Service shall not exceed the amount of fees actually received by DEXchange from you in the twelve months preceding the claim.

10. No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. DEXchange does not warrant that the Service will be uninterrupted, error-free, or secure.

11. Modifications

DEXchange reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

Add actual contact information — email address, or link to support channel (Telegram, X/Twitter, etc.). "Channels listed on our website" is too vague for legal docs.
