General Disclaimer

Critical: Confirm with a lawyer whether your specific business structure (no entity? LLC? offshore?) needs different language here. The statement that you are "not a money services business" may need legal backing depending on your jurisdiction.

DEXchange is a non-custodial cryptocurrency exchange interface. It is not a bank, financial institution, money services business, or regulated financial entity. The Service provides a user interface to access third-party exchange infrastructure and does not directly execute, settle, or guarantee any cryptocurrency transactions.

Not Financial Advice

Nothing on this website or within the Service constitutes financial advice, investment advice, trading advice, or any other form of professional advice. Cryptocurrency markets are highly volatile and speculative. You should consult with qualified financial, legal, and tax professionals before making any decisions related to cryptocurrency transactions.

Any exchange rates, estimates, or projections displayed by the Service are for informational purposes only and do not constitute a recommendation, endorsement, or guarantee of any particular outcome.

Risk of Loss

Cryptocurrency transactions carry a significant risk of loss. Prices can fluctuate dramatically in short periods. You should only transact with amounts you can afford to lose. Past performance of any cryptocurrency is not indicative of future results.

Specific risks include but are not limited to: complete loss of value of the transacted cryptocurrency, network failures or delays, smart contract vulnerabilities, exchange provider downtime, incorrect wallet addresses resulting in permanent loss of funds, regulatory changes affecting the legality or availability of certain cryptocurrencies, and cybersecurity threats.

Transaction Irreversibility

Blockchain transactions are irreversible by design. Once a transaction has been submitted to the blockchain, it cannot be cancelled, reversed, or modified by DEXchange or any other party. You are solely responsible for verifying all transaction details — including destination wallet addresses, network selections, and amounts — before confirming any exchange.

DEXchange cannot recover funds sent to incorrect addresses, incompatible networks, or unsupported wallets. Double-check all details before proceeding with any transaction.

Third-Party Services

The exchange functionality provided through DEXchange is powered entirely by third-party exchange and liquidity providers. DEXchange does not control, operate, or guarantee these third-party services. We are not responsible for the availability, accuracy, or reliability of third-party exchange infrastructure.

Exchange rates are determined by third-party providers and are subject to market conditions, liquidity availability, and provider policies. The rate displayed at the time of initiating a transaction may differ from the rate at the time of execution.

No Guarantees

DEXchange makes no guarantees regarding: transaction completion times, exchange rate accuracy, service availability or uptime, the value or stability of any cryptocurrency, the security or reliability of third-party exchange providers, or the suitability of the Service for any particular purpose.

Regulatory Compliance

Lawyer must review. You may need to explicitly list restricted jurisdictions (OFAC sanctioned countries, etc.) and potentially implement geo-blocking. This is a significant legal exposure area for crypto services.

Cryptocurrency regulations vary by jurisdiction and are evolving rapidly. It is your responsibility to determine whether your use of the Service is legal in your jurisdiction. DEXchange does not provide legal advice and makes no representation that the Service is appropriate or available for use in all jurisdictions.

Some cryptocurrencies or transactions may be restricted, prohibited, or subject to reporting requirements in certain jurisdictions. You are solely responsible for understanding and complying with all applicable laws and regulations.

Service Availability

The Service is provided on an "as available" basis. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice. We may also restrict access to certain features or the entire Service at our sole discretion.

Accuracy of Information

While we strive to provide accurate information, DEXchange makes no warranty regarding the accuracy, completeness, or timeliness of any information displayed on the Service. This includes but is not limited to exchange rates, supported currencies, transaction estimates, and any other data presented through the interface.

Indemnification

Indemnification clauses may not be enforceable in all jurisdictions (e.g., parts of EU, Australia). Lawyer should review based on your target markets.

By using the Service, you agree to indemnify and hold harmless DEXchange and its operators from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Disclaimers, or your violation of any applicable law or regulation.
